The FATCA IGA lawsuit filed by the Alliance for the Defence of Canadian Sovereignty will be heard in Canadian Federal Court in Vancouver, British Columbia, Canada starting Monday, January 28, 2019. The Court has agreed to a live webcast of the proceedings.
In 2014 the Canadian government signed an Foreign Account Tax Compliance Act (FATCA) Intergovernmental Agreement (IGA) with the United States. An IGA is an agreement between the US and a foreign government where the foreign government agrees to transmit to the US government the financial account information of US citizens with accounts.
Canadian citizens who are also "Accidental Americans" formed the Alliance for the Defence of Canadian Sovereignty to fight this implementation of FATCA in Canada. They argue that "the Canadian legislation that implements the FATCA IGA violates the Canadian Constitution, Canada’s Charter of Rights and Freedoms, the principles of Canadian sovereignty and democracy, and the fundamental rights of all Canadians." ADCS filed a lawsuit in late 2014 and now, five years later, the case will be heard in a Charter-Constitutional trial in the Federal Court of Canada.
